TERMS OF SERVICE

These Terms set out the basis on which we sell to you through this website. Please read them before ordering. Nothing in these Terms affects your legal rights as a consumer.

Our store is hosted by Shopify Inc, who provide the e-commerce platform through which we sell to you.

By using this website or placing an order, you agree to these Terms. If you do not agree to them, please do not use the site.

SECTION 1 - USING THIS WEBSITE

You must be at least 18 years old to place an order with us.

You may not use this website or anything on it for any unlawful purpose, or in any way that breaches the law.

You must not introduce viruses, malware or any other harmful code to the site, attempt to gain unauthorised access to it, or interfere with its security.

You must not scrape, spider, crawl or harvest content or data from the site, or collect other users' personal information.

You must not use the site to harass, abuse, threaten, defame or discriminate against anyone.

We may suspend or withdraw your access to the site if you breach these Terms.

SECTION 2 - HOW A CONTRACT IS FORMED

Placing an order is an offer to buy. It does not create a contract.

When you place an order we will send you an acknowledgement confirming we have received it. That acknowledgement is not acceptance of your order.

A contract between us is formed only when we send you a dispatch confirmation, or, for goods you are collecting, when we confirm the goods are ready for collection.

If we cannot accept your order - for example because the item is out of stock, because we have identified a pricing or description error, or because we are unable to obtain authorisation for payment - we will contact you and refund any payment taken in full.

SECTION 3 - PRICES AND PAYMENT

All prices shown include VAT at the prevailing rate.

Prices may change at any time, but changes will not affect an order for which we have already sent a dispatch confirmation.

Delivery charges, where they apply, are set out in our Online Product Delivery Terms and Conditions.

We take payment at the time you order. If we do not accept your order, we refund you in full.

Pricing and description errors

Our website is large and errors occasionally occur. Where the correct price or description of goods differs from that shown, and the error is one you could reasonably have recognised as a mistake, we are not obliged to supply the goods at the incorrect price. We will contact you before dispatch to tell you the correct position, and you may either confirm the order at the correct price or cancel it for a full refund.

SECTION 4 - PRODUCTS

We take care to describe our products accurately and to show them as they are. Product images and colours are shown as a guide, and the colours you see will depend on your screen. Real veneers and natural finishes vary between individual items.

Manufacturers change specifications from time to time. Where a specification changes materially between your order and dispatch, we will tell you and you may cancel for a full refund.

Some items are available in limited quantities, and some are ex-demonstration or pre-owned and therefore one-off. Where an item you have ordered is no longer available, we will tell you promptly and refund you in full.

We may limit or refuse orders that appear to be placed by dealers, resellers or distributors, and we may limit quantities per customer, per household or per order.

We may refuse an order for any lawful reason. We will not refuse an order on any ground prohibited by the Equality Act 2010.

SECTION 5 - DELIVERY, RETURNS AND WARRANTY

Delivery is covered by our Online Product Delivery Terms and Conditions.

Your right to cancel, and your rights if goods are faulty, are covered by our Refund and Returns Policy.

Our warranty cover is set out in our Refund and Returns Policy. In summary, we give a 2 year warranty on new and ex-demonstration equipment and a 6 month guarantee on pre-owned equipment. This is in addition to your legal rights, not instead of them.

Those policies form part of these Terms.

SECTION 6 - YOUR LEGAL RIGHTS AS A CONSUMER

If you are buying as a consumer, the Consumer Rights Act 2015 gives you rights that cannot be excluded or restricted. In particular, goods we supply must be of satisfactory quality, fit for purpose and as described.

Nothing in these Terms excludes or limits:

(a) our liability for death or personal injury caused by our negligence;
(b) our liability for fraud or fraudulent misrepresentation;
(c) your statutory rights as a consumer, including those under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
(d) any other liability that cannot lawfully be excluded or limited.

SECTION 7 - OUR LIABILITY TO CONSUMERS

Subject to Section 6, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not supply goods for commercial or business use. If you are a consumer, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.

We are not liable for damage caused by your failure to follow manufacturer instructions on installation, siting, operation or maintenance, or for damage caused by unauthorised repair or modification.

SECTION 8 - OUR LIABILITY TO BUSINESS CUSTOMERS

This section applies only where you are buying in the course of a business. Sections 6 and 7 do not apply to you.

Subject only to those liabilities that cannot lawfully be excluded, our total liability to you in connection with any order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price you paid for the goods in question.

We are not liable to you for loss of profit, loss of business, loss of revenue, loss of anticipated savings, loss of data, or any indirect or consequential loss.

All terms implied by statute are excluded to the fullest extent permitted by law.

SECTION 9 - EVENTS OUTSIDE OUR CONTROL

We are not liable for any delay or failure to perform our obligations where that delay or failure is caused by something outside our reasonable control, including supplier or manufacturer failure, carrier delay, industrial action, fire, flood, severe weather, power or network failure, or the acts of any government or public authority.

If such an event occurs we will contact you as soon as we can, and we will take reasonable steps to minimise the delay. If the delay is substantial you may cancel your order and we will refund you in full.

SECTION 10 - INSTALLATION AND DEMONSTRATION

Where we install equipment at your property, you are responsible for ensuring safe access, a suitable electrical supply and a suitable environment for the equipment.

We take reasonable care while working at your property. We are not liable for pre-existing defects in your property, or for damage arising from conditions we could not reasonably have identified.

Where a manufacturer recommends professional installation or setup, we will tell you at the time of purchase, together with the cost.

SECTION 11 - THIRD PARTY LINKS AND TOOLS

This site may link to third-party websites, and may give you access to third-party tools which we do not control.

Those links and tools are provided as they are, without warranty or endorsement. We are not responsible for the content, accuracy, products or services of third-party sites, and we are not liable for anything arising from your use of them.

Please read the terms and privacy policies of any third-party site before using it. Complaints about third-party products or services should be directed to that third party.

SECTION 12 - INTELLECTUAL PROPERTY

All content on this site - including text, product descriptions, photographs, graphics, logos and layout - belongs to us or to our licensors and is protected by copyright and trade mark law.

You may view, download and print content for your own personal, non-commercial use. You may not otherwise reproduce, copy, republish, sell or exploit any part of this site without our written permission.

Manufacturer brand names, logos and trade marks belong to their respective owners and are used with permission or as permitted by law.

SECTION 13 - YOUR SUBMISSIONS

If you send us reviews, comments, ideas or other material, you grant us permission to use, edit, publish and reproduce it in any medium, without payment to you. We are not obliged to keep it confidential, to use it, or to respond to it.

You confirm that anything you send us is your own, does not infringe anyone else's rights, and is not unlawful, defamatory, abusive or obscene. You are responsible for what you send us.

We may remove any content we consider unlawful or objectionable, but we are not obliged to monitor submissions.

SECTION 14 - YOUR INFORMATION

We use your personal information in accordance with our Privacy Policy, which forms part of these Terms.

You agree to give us accurate and current information when you order, and to keep your account and contact details up to date so that we can complete your order and contact you about it.

SECTION 15 - WEBSITE AVAILABILITY

We do not guarantee that this website will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, and we will give reasonable notice where we can.

Information on this site is provided for general guidance. We keep it as accurate and current as we reasonably can, but we do not warrant that it is complete or error-free, and we are not obliged to update it except where the law requires.

SECTION 16 - COMPLAINTS

If something has gone wrong, please tell us. Put your complaint in writing to elizabeth@martinshifi.co.uk, or write to Elizabeth Gould, Martins Hi-Fi, 85-91 Ber Street, Norwich, Norfolk NR1 3EY.

We will acknowledge your complaint within two working days and aim to give you a full response within ten.

SECTION 17 - GENERAL

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in force.

If we do not insist that you perform any of your obligations, or if we delay in enforcing our rights, that does not mean we have waived those rights.

We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens, and your rights will not be affected.

This contract is between you and us. No other person has any right to enforce any of its terms.

These Terms, together with our Online Product Delivery Terms and Conditions, our Refund and Returns Policy and our Privacy Policy, form the entire agreement between us in relation to your order.

SECTION 18 - CHANGES TO THESE TERMS

We may update these Terms from time to time by posting the revised version on this page.

The Terms that apply to your order are those in force on the date you placed it. Changes we make after that date do not affect an order already placed.

SECTION 19 - GOVERNING LAW

These Terms, and any dispute or claim arising out of them or their subject matter, are governed by the law of England and Wales.

If you are a consumer, you may bring proceedings in the courts of England and Wales, or in the courts of the part of the United Kingdom in which you live. If you are a business, the courts of England and Wales have exclusive jurisdiction.
